    Specialist Legal Recoveries On & Off Balance

    Job Summary

    The main purpose of the role is to conduct risk management through cost effective legal recovery of outstanding bad debt exposure by instructing 3rd party professional service providers and engaging with internal customers in the collections, legal and insolvency process.

    The main purpose of the role is to conduct risk management through cost effective legal recovery of outstanding bad debt exposure by instructing 3rd party professional service providers and engaging with internal customers in the collections, legal and
    insolvency process.

     

    Key Accountabilities:

     

    Managing the assigned legal portfolio

    • Formulate the appropriate recovery strategy to recover as much as possible and to mitigate any additional impairment requirements

    • Instruct panel attorney to institute legal action against all liable parties and management of legal process until the matter is resolved

    • Initiate, entertain and approve any negotiations or settlements proposals within personal discretion and refer to mandate official if outside personal mandate.

    • Provide ongoing instructions to attorney inclusive of evidence required by court such as factual evidence, reconciliations and documentation

    • Draw and submission of claim and documentation required in
      liquidations/sequestrations and deceased estates

    • In liquidation/sequestration ensure that the liquidator is protecting the Bank’s interest with regards to our assets, whether it is a vehicle, immovable property or any other.

    • Assess the risk position by analysing the overall security position to ensure the
      correct level of impairment is raised.

    • Perform financial and non-financial analysis on the client that will support and
      underpin the recovery strategy to be implemented for a particular group or
      customer

    • Produce relevant management information and statistics as required. This includes reports to the Watchlist Committee if required.

    • Manage bad debt exposures by taking daily legal recovery decisions and reviewing information from various systems and taking loss decisions accordingly.

    • Report all risk and loss events as a result of fraud or error

    • Monitor progress on defended/opposed matters in consultation with Group Legal and submit Form B.

    • Engage with Team Leaders and higher levels on a matter to matter basis regarding complex matters.

    • Submit Khula claim and attend to all queries until finalised

    • Action all new accounts within prescribed time frame

    • Follow up on all accounts regularly and manage diary dates

    • Ensure that correct risk types and status codes are allocated to accounts

    • Accept full and final settlements or refer if outside mandate

    • Recommend write-off or canning of account

    • Attend any meetings or committees as and when required, e.g Watchlist Committee.

    • Negotiate with clients where necessary within own mandates, on the most
      favourable terms possible and the execution of written recommendations to
      mandate holders and or committees in respect of those matters which exceed own mandate.

    • Requesting of valuations of properties

    • Sign all documentation e.g. affidavits for legal action when required.

    • Appear in court and present evidence when required to do so.

    • Decide whether to grant leave to defend or proceed with Summary Judgment
      application

    • Accept payment arrangements and monitor adherence to the agreement

    • Consider and accept/recommend any offers on security assets like vehicles or
      immovable property.

    • Attend to and finalise all queries/disputes and complaints from clients. If complaint has been officially lodged attending to and finalising it within timeframe on CCP system.

    • Peruse offers to purchase (e.g. on property) and make detailed recommendation as to whether it should be accepted or not.

    • Attend auctions as and when required

    • Visit properties and attorneys as and when required

     

    Management of 3rd party relationships

    • Responsible to provide instructions to 3rd party service providers as first point of entry with clear guidelines including monitoring the progress to protect the Bank's interest

    • Maintain effective and professional working relationships with attorneys, EDC’s, insolvency practitioners and auctioneers

    • Identification of poor performance trends and recommendations to management to exit relationship

    • Pro-actively manage legal risks associated with the legal recovery portfolio, client interaction, internal customer interaction and other role players in the organisation

    • Embed and maintain internal stakeholder relationships with Business Units
      including monthly interactions to discuss and resolve account specific issues and opportunities

     

    Financial performance of assigned portfolio

    • To optimise recovery cash flows by implementing effective and timely action

    • Ensure that security values are updated and correct as to ensure that losses are accurately accounted for in terms of policy and accounting practices

    • Investigate and question 3rd party fees and commission invoices including Liquidation and Distribution (e.g. for Capital Gains Tax) accounts to ensure correctness and to minimize the level of legal and other expenses.

    • Assertive engagements with clients and service providers in order to close transactions, settlements and compromises to the benefit of the Bank focusing on the releasing of impairment requirements and recovering as much as possible.

    Minimum requirements:

    • B-degree preferably B Com or Legal (NQF level 7) and/or

    • AIPSA insolvency Diploma or other Diploma in Insolvency

    • 3 years Credit, legal or Insolvency experience

    • Preference will be given to South African Citizens and Permanent residents of South Africa in possession of proof of permanent resident status.

    Business Process Design/Improvement


    Outputs to deliver this accountability:


    - Interacting with channel and process owners, conduct business process needs analysis to understand the requirements, inputs, handoffs and outputs of the process where required.
    - Facilitate process design workshops with participants from the processing areas and the process owners. Map the processes using the bank's approved mapping standards. This includes facilitating, designing and documenting process decomposition diagrams and defining and documenting new business processes to cover the total life cycle of the product or service covered.
    - Review process maps to ensure that all regulatory, compliance and operational risk control elements are incorporated and highlighted.
    - Obtain approval from business process owners on the final products before publishing on the Business Process Repository.
    - Participate in the test cells for new processes and highlight any issues or concerns.

    - Ensure that corrections are made prior to live implementation.
    - Assess the risk and potential impact of any process changes requested from a systems, control and operational risk perspective. Highlight the risks to the process owners. Identify where systems designs need to be altered in order to integrate the business solution and highlight to the process owners.
    - Assess the financial impact (direct such as development/training cost and indirect such as savings) of proposed changes and obtain approval from process owners.
    - When required, interact with the Business Risk Officer or Management Assurance to ensure that process changes meet control requirements.
    - Monitor implementation of new processes to ensure that anticipated benefits are realised.
    - Support the product development process by advising on the most appropriate operational processes to support the product's implementation. Interact with the impacted operations processing area to obtain their input and approval for the final product process.
    - On at least an annual basis, critically review all critical and major processes in place in the business area and identify areas for potential improvement. Obtain approval from the process owner to conduct detailed work and create recommendations for improvement. Ensure updated processes are published and old ones removed.
    - Support process owners to design change impact assessment tools and change project plans. Occasionally assist with monitoring progress against the project plan.

    Key Responsibilities

    • Receive completed deceased estate reporting documents from the Fiduciary Consultants and Lean system and make telephonic contact with the client
    • Manual intake of estates
    • Report the deceased estate to relevant stakeholders via written correspondence, newspaper and Government Gazette
    • Advertise (e.g. advertise in the local newspaper and Government Gazette) and for any debtors or creditors (section 29 notification) in respect of the estate late
    • Receive relevant information as requested by the various stakeholders and start redeeming and transferring assets
    • Draft the liquidation and distribution account to reveal the true reflection of the assets and liabilities as at date of death and submit outstanding tax returns
    • Advertise (for twenty one (21) days) the Liquidation and Distribution account (section 5 notification) in the local newspaper / Government Gazette and with the Magistrate in the district were the deceased resided twelve (12) months prior
    • Instruct the Absa panel attorneys on the expiry date of the advertisement
    • Obtain final tax assessment from SARS and finalise the deceased estate
    • Achieve set target as set out by management at the beginning of the year
    • Ensure that post (incoming mail, fax and correspondence) and filing is up to date as per the company norms

    • Ensure compliance to policies, legislation and regulations.
    • Obtain appropriate sign off from business units Heads and other relevant parties on design before moving into the production environment.
    • Where data integrity is questionable, send out communication to relevant stakeholders via email to this effect, highlighting issues and where appropriate, proposing solutions.
    •  Drive to completion, where appropriate, the implementation of initiatives to facilitate appropriate application of governance procedures thus ensuring data integrity and quality
    •  Adhere to the core Data Governance disciplines as defined by the Data Governance Organisation (DGO) when performing business intelligence activities within the SBU (business unit). This includes: data quality management information lifecycle management and information security and privacy.  
    • Conduct integrity checks on all extracted data to ensure correct data is incorporated into the reports.

    • Develop and maintain relationships within relevant business units understand their requirements and gather feedback.
    • Work with stakeholders (Business Units, Group Technology etc) to create and maintain a portfolio of technology MI, utilising consistent and validated data sources
    • Check that information is correct as it is the only source of input and incorrect reporting could have financial and brand implications for the Absa Group
    • Stay abreast of knowledge and skills relevant to the level and area of work, as well as actively seeking to attain those required for the next level of work
    • Develop a thorough knowledge of various systems and related reporting. 
    • Recommend changes to the way of work in accordance with best practice industry standards.
    • Work with the end users and client team members to define application functional and usability requirements. Ensure that other project team members understand the implications of functional and usability requirements.
    • Educate users where required on the design or how to utilise the solution.

     

    Education and Experience Required

    • Minimum Requirements - Bachelor’s Degree in Mathematics, Statistics, Business or similar with a focus on analytics, business information management or equivalent NQF level 6 qualification
    • 3-4 years relevant experience in Business Intelligence / Management Information.
    • Proficient in MS Office (Word, Excel, PowerPoint and Outlook) and the Internet
    • Working knowledge of Business Intelligence tools i.e Business Objects, QlikView, Data warehouse
    • Previous experience in dealing with cross functional and multiple jurisdiction team would be advantageous
    • Experienced in senior stakeholder management

    • Expert Data analysis skills – constantly analyse data to improve understanding of client behaviour
    • Advanced Computer Literacy using all tools (e.g. Excel, SAS, SQL, etc.)

    Job Summary

    • You will be focused on the research and evaluation of security solutions and technologies, including the design and delivery of security solutions via the formal engagement of the Security Risk and Architecture teams and in rare instances, direct engagement via the business drivers.

    Job Description

    What you’ll get to do:

    The role is within the Security Operations team in our Converged Security Office and your responsibilities will include the following:

    • Develop technical designs following the research and evaluation of security technologies and solutions in line with group strategy and/or what is appropriate for the estate
    • Review of proposed security technical designs
    • Evaluate, test and pilot new security tools following the formal engagement of Security Risk and/or business drivers
    • Develop detailed technical configuration documents, working closely with the security architecture and standards group
    • Support of Security Risk and Architecture in the secure delivery of products both emerging and updating of existing solutions as per business needs
    • Review and evaluation of new security architectures and designs
    • Combine the knowledge of security technology evaluations and emerging products with security business needs
    • Ability to work with other engineers both internally and external to Absa; learning and evaluating emerging technologies
    • Ability to manage vendor relationships knowing due diligence goes beyond just the technology and engaging with the right business people to ensure Absa fully leverages vendor relationships

    What do you need to get in?

    • NQF level 6 B Degree will be advantageous
    • 2 years Security Engineering experience preferably within a large financial institution
    • Industry & Vendor certifications – AWS, SANS, ISACA, Checkpoint, Cisco etc. preferred
    • Experience with Linux and Windows operating systems, scripting languages like Python, and cloud provider ecosystems like Amazon AWS
    • Excellent understanding of security strategies and technologies including but not limited to secure global network designs, cryptography, remote computing, cloud-based technologies, server and application hardening, Web services, AAA, compliance and auditing, secure development lifecycles, software auditing, penetration testing and security monitoring
    • Strong knowledge of information security frameworks and standards such as ISO27001/17799
    • Comprehensive grasp of emerging security technologies for mobile & digital channels including core, backend and big data
    • Understanding of mobile and emergent threats in the digital space
    • Knowledge of common mobile device and associated application architectures including core infrastructure and applications services as well as peripheral applications/services
    • Knowledge in multiple information security technologies and their strengths and shortcomings
    • Experience with securing information for cross-functional, cross-platform applications
    • Monitors marketplace trends, vulnerabilities, emergent threats and audit/control issues
    • Knows what should be communicated and when
    • Actively seeks ways to understand and mitigate risk
    • Able to shift well from task to task
