    Manager: Legal Advisor

    Purpose of the Job: Reporting to the Manager: Legal Advisor, the successful incumbent is responsible to provide management and technical leadership support in line with the strategic objectives of the organisation as determined by the Board of the RAF; to manage, monitor and report on legal advice provided to the Board, Executive Management and business units; to publish a monthly internal legal advice newsletter; to prepare legal articles for publication in external media; and to collaborate with the Training Department on specific training requirements and the development of training material.

    Key Performance Areas

    Provision of Legal Advice to Business

    • Conduct legal research and prepare legal opinions.
    • Instruct attorney to brief counsel on legal opinion.
    • Where appropriate consult with attorney and counsel.
    • Collaborate with the Training Department on specific training requirements and the development of training material.
    • Write articles for the monthly Legal Advice Newsletter.
    • Write articles for publication in external media.
    • Vet Annual Reports, Annual Performance Plans, the RAF Website, marketing and other material for legal accuracy; and
    • Maintain and update legal advice register.

    Policy Review and Implementation

    • Contribute to the development and implementation of departmental policy, procedures and processes.
    • Keep up to date with effective policy and practice execution strategies.

    Reporting

    • Develop functional reporting systems, for management, projects or performance reporting.
    • Prepare proposals, briefings, presentations, reports, and other documentation and provide management information both verbally and in report format.

    Stakeholder Management

    • Facilitate and manage communication with relevant internal and external stakeholders in relation to investments and proactively and progressively manage the relationships.
    • Manage relationships with vendors, service providers or procurement teams and ensure that all relevant procured items are invoiced and paid on Time.
    • Communicate with all levels of stakeholder contact.

    Qualifications and Experience

    • Bachelor's Degree in Law or equivalent
    • Relevant 5 - 7 years’ experience in a contracts function and general corporate law.
    • Proven contract drafting, vetting and negotiation experience.
    • Proven Legal Advice experience.
    • Proven prior experience in a public law environment.
    • Legal Research experience.
    • Code 8 drivers Licence.

    Manager: Corporate Litigation

    Purpose of the Job: Reporting to the Senior Manager: Corporate Legal Services, the successful incumbent is responsible to provide management and technical leadership support to the Senior Manager: Compliance of the Legal and Compliance Department in line with the strategic objectives of the organisation as determined by the Board of the RAF and to manage, monitor and report on corporate litigation and RAF compensation litigation where issues of constitutionality are raised.

    Key Performance Areas

    Management of Referred Claims Litigation, All Constitutional Litigation, Non-Claims Litigation and All Applications where the CEO is Cited as a Party

    • Manage, monitor and report on litigation managed by the Litigation section.
    • Assess the litigation risk and advice on litigation strategy.
    • Manage service providers providing legal services to the Litigation section.
    • Instruct and consult with external legal service providers.
    • Monitor the management of the litigation process and instructions to legal service providers throughout the process.
    • Submit Litigation Reports to the Risk Committee.
    • Draft directives to give guidance to the RAF on the effect of important judgments.
    • Draft briefing notes to the CEO and COO.

    Policy Review and Implementation

    • Contribute to the development and implementation of departmental policy, procedures and processes.
    • Keep up to date with effective policy and practice execution strategies.

    Reporting

    • Prepare and submit reports as and when required to provide progress updates and/or inform management decisions.

    • Allocate, direct, motivate and evaluate subordinates to help them achieve their individual goals.

    Qualifications and Experience

    • Bachelor’s Degree in Law or equivalent.
    • Postgraduate in Law related qualification will be an added advantage.
    • Admission as an Attorney of the High Court or Advocate.
    • Right of appearance in the High Court will be an added advantage.
    • Relevant 6 - 8 years’ experience in Litigation environment of which 2 years must have been on a supervisory level/ area of expertise/ management level.
    • A valid driver’s license

    Officer Determination x10

    Purpose of the Job: To provide claims handling to ensure prompt and fair settlement of claims.

    Key Performance Areas

    To estimate value of loss in terms of DOA

    • Review documentation or determine further documentation needed.
    • Scrutinize claims documentation (e.g. payslips, etc.)
    • Determine and estimate quantum of claims.

    To liaise with panel of experts for expert advice

    • Consider experts reports particularly actuarial calculations.
    • Instruct the relevant experts to quantify the benefits e.g. actuary, industrial psychologists on the advice of and approval of the assessor and/or senior assessor.

    To quantify benefits and make appropriate offers.

    • If no expert is required, calculate the value of benefits.
    • Loss of support/earnings calculation on advice of the Assessor and/or Senior Assessor.
    • Provide details of income and fringe benefits in major sectors.
    • Determine contingency deductions to be applied.
    • Interpretation on the cap limit under the Amendment Act.
    • Assess the funeral account and award benefit in terms of the ARAF Act.
    • Communicating and explaining offers to claimants.
    • Attending to queries with claimants.
    • Knowledge of rules of collateral and accelerated benefits.
    • Factor in contingencies also consider merits allocated.
    • Prepare offer as approved by the Assessor or Senior Assessor.
    • Consider any prior payments/interim payments/WCC/Social grants/EIL under the advisement or approval of the assessor or senior assessor.
    • Obtain approval in terms of delegation and send out offer.
    • If accepted request payment.
    • If not accepted revise the offer.
    • If summons served, refer matter to Litigation.

    To provide claims assistance during road shows

    • Drawing files for road shows.
    • Liaise with claimants to attend the road show.

    Qualifications & Experience

    •  NQF 7 Bachelor’s Degree or Advanced Diploma qualification
    •  Relevant 3 years’ experience in claims experience

    Administrative Assistant X4

    Purpose of the Job:

    • To provide administrative support for the Officer, Senior Officer and Team Leader to ensure that the branch is run efficiently and effectively.

    Key Performance Areas

    To follow up on queries from stake holders.
