    Group Tax Specialist

    JOB PURPOSE

    • To provide tax assistance and support to the Group Executive: Tax (“GET”) and allocated GTM for Aspen Group companies by ensuring the managing and overseeing of the Aspen Group’s tax affairs

    KEY PERFORMANCE AREAS

    • Accounting for taxes and related party transactions:
    • Ensures that corporate tax liabilities for your region are accurately recorded, within the deadlines reflected in the Group Finance timetable.
    • Ensures that all supplementary information that is required to be submitted as reflected in the Group Finance timetable, is reviewed within forty-eight hours of the deadline and that feedback is provided to the business in relation to those submissions.
    • Ensures that the segmented income statement is received from every company in your region, on a monthly basis, is reviewed uploaded to TRCS within forty-eight hours of the date stipulated in the Group Finance timetable. In addition, work with your GTM to early identify issues where the Transfer Pricing Policy is not being met.
    • Works with management to implement recharges of expenses, in accordance with the Transfer Pricing Policy.

    Transfer pricing:

    • Securing a credit rating for the respective company, within ten business days of the finance transaction being identified, calculating the appropriate margin that should be charged and preparing the memorandum for submission and implementation by the business.
    • Work with Group Legal to ensure legal agreements that are required to be entered into to support new transactions are issued in template form and that the agreement is issued in relation to the company that you are responsible for.

    Tax compliance and audits:

    • Ensures each company in the region meets all of their tax reporting obligations to achieve the deadlines set by the Tax Authority. This responsibility covers corporate tax, value-added tax and transfer pricing returns/notifications.
    • Prepares the returns that have been identified by the GTM and submit those to the Tax Authority, once the return has been reviewed by the GTM and the local file (refer below) has been prepared.
    • Prepares all local files are for companies in the region, prior to the submission of the corporate tax return.
    • Prepares the controlled foreign company tax return for each company in the region.
    • Prepares all responses to any query that is received by a Tax Authority in collaboration with management and the appointed advisors. Ensure that these are reviewed by the GTM prior to the replies being submitted to the Tax Authority.

    Legislation:

    • Prepares training slides in relation to topical questions relating to developments in international tax, corporate tax and VAT, in accordance with the training timetable.

    Opinions:

    • Prepares opinions, that are either identified as being necessary, as requested by the business which are highly technical opinions or as requested by the GTM and ensure that these opinions are reviewed by the GTM before they are released to the business.
    • Stakeholder engagement:
    • Actively engage with the business in undertaking all the work that is allocated.
    • Tax policy and tax risk management:
    • Ensures that every company in the region is applying the tax policies that are issued by Group Tax
    • Implements all standard operating procedures that are published for Group Tax.

    Group Tax Assistant Accountant

    JOB PURPOSE

    To effectively manage the tax reporting solutions of Group Tax

    KEY PERFORMANCE AREAS

    SAP implementation:

    • Actively participate, as the Group Tax Prepare a requirements document for the SAP implementation, with the support of the GTM and the GTA, and ensure these requirements are incorporated in the SAP project plan/backward integrated into existing SAP S 4 HANA environments.

    Vertex:

    • Act as super user for Vertex.
    • Prepare a requirements document for the Vertex implementation, with the support of the GTM and the GTA, and ensure these requirements are incorporated in the SAP project plan/backward integrated into existing SAP S 4 HANA environments.
    • Actively participate, as the Group Tax representative on all Vertex implementations.
    • Work with our advisors/consultants to ensure all changes that are required in Vertex are made, for all Group companies that have activated Vertex, with the approval of work being undertaken by the GTRM.

    TRCS:

    • Act as super user for TRCS.
    • Once notified by the GTM that changes are required to be made to the rules in TRCS, work with our service providers to ensure that the rules are updated and that they generate the correct result, with the approval of work being undertaken by the GTA.
    • Once notified by the GTM that the statutory tax rate has changed, work with our service providers to ensure that the rules are updated and that they generate the correct result, with the approval of work being undertaken by the GTA.
    • Maintain a log of all changes that are being made to TRCS.
    • Create a schedule to receive changes in the TRCS users and implement that schedule to ensure that the rules are updated and that they generate the correct result and that the workflows are released in accordance with the schedule, with the approval of work being undertaken by the GTA.
    • Regularly engage with the professional team to create new reports so that they can effectively monitor and undertake their work. Once new reports are identified or amendments to existing reports are identified, work with our service providers to ensure that the rules are updated and that they generate the correct result, with the approval of work being undertaken by the GTA and the GTM.
    • Update all templates that are being used by the Group Tax team, to the extent that there is a change in the chart of accounts master data and other data that is being collected by the Group Finance Consolidation team (this would be to ensure that we are not requesting duplicate information from the broader finance community), with the approval of work being undertaken by the GTA.
    • Monitor that our service provider is testing the impact of changes that are released by Oracle on our development environment and reporting that no adverse impacts will arise, once the Oracle changes are moved into the production environment, with the approval of work being undertaken by the GTA.
    • Act as the first line of support for the business, to the extent that the GTS is unable to resolve the issue experienced by the Group company.
    • Develop new ways of preparing corporate tax calculations, with the support of the GTM, using the information that is extracted from SAP and ensure these are implemented, with the approval of work being undertaken by the GTA.

    EPRCS:

    • Act as super user for EPRCS.
    • Obtain employee numbers from the team responsible for preparing the Integrated Report and insert those into TRCS, with the approval of work being undertaken by the GTA.
    • Run the country by country report, review it for accuracy and submit the same to the GTS responsible for managing Aspen Holdings’ tax affairs so that it can be uploaded on SARS E-filing, with the approval of work being undertaken by the GTA, with the approval of work being undertaken by the GTA.

    Group Tax Manager: Africa

    JOB PROFILE

    To provide support to the Group Tax Executive by controlling the tax affairs, including providing advice, of individual companies in the assign region ensuring that the Group meets its tax obligations.

    KEY PERFORMANCE AREAS

    Accounting for taxes and related party transactions:

    • Ensures that corporate tax liabilities for the region are accurately recorded, within the deadlines reflected in the Group Finance timetable, by actively managing respective team members to achieve these deadlines.
    • Ensures that the TRCS submissions for the region are made on time, as reflected in the Group Finance timetable and is reviewed by the Tax Specialist within forty-eight hours of the submission deadline with feedback in this regard being sent to management.
    • Reviews all manual adjustments made by the Tax Specialist and understand why this has taken place and recommend changes to any tax rules to the Tax Technology Specialist (“TTS”), if these adjustments will be made on a permanent basis.
    • Ensure a note is prepared for each significant manual adjustment and that these notes are approved by the Group Tax Executive (“GTE”) within forty-eight hours of the note being prepared and before the Group’s effective tax rate (“ETR”) has to be finalized, as reflected in the Group Finance timetable.
    • Ensures that all changes in accounting standards are fully considered from a tax perspective, for the region, and make recommendations to the TTS of additional rules that must be created.
    • Assesses tax positions taken by the region and provide input into the Group’s IFRIC23 register.
    • Oversees the accurate disclosure of corporate tax liabilities and related parties notes in the company’s in the regions annual financial statements. In addition, ensure that there is no ambiguity relating to transactions that have been entered into, which could give rise to queries by the tax authorities. The work should be performed in accordance with the Group Finance timetable that is prepared in relation to annual financial statements that are issued by that team.
    • Works with the auditors that are appointed to conclude the annual external audit for companies in the region, to ensure that a report is issued by 23 July (or the nearest Friday to this date) confirming that no tax issues are noted from their review of the tax calculation.
    • Ensures that the segmented income statement is received from every company in the region, on a monthly basis, is reviewed by the Tax Specialist in the team and uploaded to TRCS within forty-eight hours of the date stipulated in the Group Finance timetable. In addition, work with the Tax Specialist to early identify issues where the Transfer Pricing Policy is not being met.
    • Reviews the recharge calculations that are performed by the Tax Specialist.
    • Tax compliance and audits:
    • Ensures each company in the region meets all of their tax reporting obligations by actively managing respective team members to achieve these deadlines – no return should be submitted without it being prepared by the Tax Specialist or the company’s advisors and reviewed. This responsibility covers corporate tax, value-added tax and transfer pricing returns.
    • Risk assess positions taken in the tax returns that are being submitted and ensure that those risks are fully understood and if significant, brought immediately to the GTE’s attention so that a decision can be made as to whether or not the proposed position should be taken in the returns.
    • Ensures that the right amount of tax is paid by the companies in the region to limit the Group’s exposure to tax refunds and actively manage the recovery of any amount that is due to the Group by any tax authority.
    • Ensures that the Tax Specialists are preparing the VAT returns for your region and that these are reviewed.
    • Ensures that all local files are prepared for companies in the region, prior to the submission of the corporate tax return, by managing respective team member’s workloads to ensure this requirement is met. In addition, the local file must be reviewed and the CFO of the company prior to the submission of the corporate tax return.
    • Ensures that respective team member prepares the controlled foreign company tax return for each company in the region.
    • Ensures that every response to any Tax Authority is reviewed and risk assessed prior to the response being submitted to the Tax Authority. Actively manage all audits that relate to transfer pricing or international tax, with the support of your Tax Specialist and our appointed advisors (where necessary).
    • Prepares advance ruling applications that are either identified by yourself or the GTE and secure those rulings from the Tax Authority.
    • Transfer pricing:
    • Review and sign off on the credit rating, appropriate margin and memorandum that is prepared by the TS, before it is released to the business unit.
    • Work with Group Legal to ensure legal agreements that are required to be entered into to support new transactions are issued in template form and that the agreement is issued in relation to the company that you are responsible for.
    • Undertake a comparable uncontrolled price (“CUP”) assessment for companies the region that you are responsible for, using the standard templates. Maintain this on an annual basis and ensure that if any CUP is assessed that this fact is brought to the team’s attention so that the statements made in our local files and the reliance on the transactional net margin method are adjusted and benchmark studies are no longer secured.
    • Work with your fellow RTM’s to ensure that transactions are appropriately and consistently described in each of the local files that are being prepared for the Group.
    • Bring all changes to the GTE’s attention so that the transfer pricing policy and all related policies can be updated.
    • Work with the Tax Administrator to keep the local file and master file database up to date.
    • Legislation:
    • Monitors changes in tax law – assess how these could impact on the company’s in the region and share this information with the business unit.
    • Implements value-adding initiatives arising from changes in tax law.
    • Manages, in accordance with the training timetable, monthly training relating to developments in international tax, corporate tax and VAT.
    • Corporate activities affecting your region:
    • Reviews all legal agreements that are entered into by companies in the region to ensure tax provisions are appropriately included, that the right party is entering into the agreement and that the structure of the agreements optimizes the taxes arising under the agreement.
    • Reviews all board resolutions entered into by companies in the region to ensure they meet tax reporting requirements and do not give rise to tax risk.

    Opinions:

    • Reviews all opinions that are issued by the Tax Specialist and ensure that these opinions are either second reviewed by the GTE or our appointed advisors prior to those being released to the business.
    • Prepares opinions, that are either identified as being necessary, as requested by the business which are highly technical opinions or as requested by the GTE and ensure that these opinions are reviewed by the GTE and, if the GTE deems it necessary, by our appointed advisors before they are released to the business.
    • Once released to the business, facilitate a meeting with the person that the opinion has been issued to so that the person fully understands the opinion that has been issued.

    Stakeholder engagement:

    • Embeds a culture of collaboration across functions and business units within your region.
    • Day-to-day management of the relationship with the company’s appointed tax advisors including management of the budgets associated with their activities.

    • Ensures that every company in the region is applying the tax policies that are issued by Group Tax and that your Tax Specialists are implementing the standard operating procedures.

    Staff Management:

    • Implement a process to have regular cadence sessions with each team member during which work allocation and performance against KPIs are discussed
    • Actively coaching and mentoring direct reports and the broader staff, providing feedback and developing and growing employees to develop their technical and soft skills
    • Work with the TS and GTE to undertake performance reviews of the TS and identify areas of growth and development for inclusion in each individuals KPI

    Human Capital Business Partner

    OBJECTIVE:

    The primary purpose of the HC Business Partner is to execute the delivery of HR objectives that enables the business to achieve its goals. The job incumbent operates as a business partner providing business driven insights to support decision making and determine appropriate business and people interventions. The HRCBP is responsible for supporting effective management of people within the business division a comprehensive HC service within the areas allocated.     KEY RESPONSIBILITIES:

    • Business planning
    • Oversee the HC Business Partner function within the respective divisions allocated with a view to increasing culture of performance and staff engagement.
    • Work closely in partnership with the HR team in SA Commercial to ensure the business area is supported effectively.
    • Manage all processes and dealings with employees and line managers to act in a proactive manner ensuring preventative measures occur.

    HR Data Analytics and Insights Monitor

    • Ensuring that solid basic transactional HC functions are managed within the function according to required procedures and standards.
    • Develop procedures and interpret and apply policy for area of expertise to achieve specified outputs, or advise the wider business on application of policy, then monitor implementation of those procedures within the organization.
    • Work with the business unit to translate business needs into HC requirements and employee experience.
    • Consult on all HR policies, processes and procedures by providing advice to line business

    Information and Business Advice

    • Provide specialist guidance to managers at the business unit to enable the implementation of policy, projects, and change initiatives. Drive effective execution of HC policies and processes in their business.
    • Gather Insights to make robust people and business decisions, basing this on analysis of data and sound understanding of the trends. Proactively sharing insights, risks and opportunities identified with business leadership.

    Change Management

    • Ensure that OD and change management strategies are implemented and monitored
    • Facilitate change management, ensuring that minimal risk is incurred while conducting changes, and staff morale is maintained.
    • Find ways to build morale, improve workplace relationships, and boost productivity

    Organizational Capability building

    • Responsible for implementing initiatives at the business unit level and may support the design of specialized or customized communications and initiatives.
    • Support stretch assignments for developmental purposes within the business areas of responsibility.
    • Coach and educate the line managers in people management.
    • Coach leaders in managing industrial relations cases and implementing corrective action to ensure a high-performance culture is maintained. This includes assisting with and compiling all administrative documents in this regard, including warnings, Performance Improvement Plans, Charges, and Disciplinary packs amongst other elements.
    • Finds ways for managers to build meaningful connections with their team members and with each other. Facilitate team cohesiveness.

    Employee relations

    • Promotion of sound employee relations practices

    • Facilitate the sound employer-employee relations through managing and overseeing effective and efficient implementation and compliance with labour laws
    • Manage conflict/disputes
    • Manage consultations with line managers within their teams.
    • Implement and communicate the employee relations strategy and ensure that employee relations are achieved

    • Oversee the implementation of the wellness programme
    • Plan and be responsible for staff engagement activities and events
    • Guide and coach line during ER related matters
    • Handling Disciplinary enquiries, CCMA cases up to arbitration, and Grievances
    • Assist employee and line to prepare for all ER related hearings

    EDUCATION & EXPERIENCE:

    • Matric
    • 3 year Degree in Human Resources or BA/B.Com degree (Industrial or Organisational Psychology)
    • At least 5 Years’ experience within an HR Generalist role focusing on all facets of the lifecycle of an employee
    • At least 5 years’ experience as a HC Business Partner- experience in the following: change management / human capital planning / ER and IR.
    • 3 years’ experience advising on Industrial Relations issues
