    Senior Legal Advisor 115948

    Short Description / Purpose of Job

    • Provide subject matter expertise on Labour and Employment Law to ensure labour law practices across the Group are compliant with labour and employment laws, case law and regulations.

    Recruitment Description / Key Accountabilities

    • Contribute to the formulation of the Group Labour Law philosophies and strategies.
    • Draft and negotiate various types of labour law related contracts of employment.
    • Render Labour Law legal advisory services to Business Units and Corporate Centre at a strategic, tactical and operational level.
    • Provide Labour Law legal advice and formulate legal opinions in consultation with external Legal Experts and other internal Legal Centre of Excellence (CoE) teams:
    • Provide legal advice on employment contracts, conditions of employment both on collective and individual labour law elements, labour relations, the application and implementation of case law, policy drafting related to labour law, disciplinary steps and conduct of disciplinary hearings on misconduct and unfair labour practices as well as other labour law related arrangements.
    • Manage, termination and subsequent remedies such as settlements, amendments, litigation and arbitrations in labour law and employment matters.
    • Facilitate the implementation of any changes in the legal landscape to ensure legal compliance and manage compliance with the changes in Labour Law from time to time.
    • Lead the legal dispute resolution process in the CCMA or Bargaining Council(s) by preparing for the litigation, obtaining approval from relevant forums, appointing and liaising with external legal counsel and managing the legal spend within planned parameters.
    • Appear in person by representing the employer during the legal dispute resolution process in the CCMA or Bargaining Council(s) or Labour Court by preparing for the litigation, obtaining approval from relevant forums, and managing the legal spend within planned parameters.
    • Work with external Legal Counsel and manage their service delivery in the provision of legal opinions and resolving litigation and legal disputes and managing the legal spend within planned parameters.
    • Keep up to date and advise on relevant legislation, statutory instruments, codes of practice and corporate policies relevant to Labour & Employment Law.

    Formal Education

    • University Bachelor’s Degree (LL.B)

    Min Experience

    • 10 – 11 years relevant experience

    • Admitted attorney/advocate

    • Reporting: The ability to access information from databases, forms, and other sources, and prepare reports according to requirements.
